Roblox Lawsuit Over Children's Privacy Sent to Private Resolution Process
What Happened
A federal judge in California has ruled that a lawsuit against Roblox, the popular online gaming platform, must be handled through arbitration instead of going to court.
Arbitration is a private process where a neutral third party makes a decision instead of a judge or jury.
The Lawsuit
Parents Michael and Salena Garcia filed the lawsuit on behalf of their child (referred to as "R.G." to protect their identity).
They claimed that Roblox was secretly collecting personal information from its users, including children under 13 years old, without proper permission.
Why the Case Was Sent to Arbitration
Roblox argued that when users sign up for the platform, they agree to the company's terms of use, which include an agreement to resolve disputes through arbitration rather than in court.
The judge agreed with Roblox. He found that when users click buttons like "Sign Up" or "Continue" on the platform, they are clearly told that they are agreeing to the company's rules.
The Garcia family created three accounts and clicked these buttons multiple times between May 2023 and March 2025.
The Court's Decision
Judge Wesley Hsu ruled that the terms-of-use notice was clear enough for users to understand. He based his decision partly on a similar case from 2024 involving Warner Bros. Entertainment.
The Garcia family argued that the arbitration agreement was unfair, but the judge disagreed. He noted that Roblox's rules do allow for certain types of relief if the law permits it.
What This Means
Because the case is going to arbitration, Roblox's request to dismiss the lawsuit entirely is no longer being considered. The dispute will now be settled privately rather than in a public courtroom.
Roblox denies the claims that it improperly collected children's data.
Related Legal Action
In a separate case, other parents have also sued Roblox over similar concerns about tracking children's data without consent.
